What Kino Bay Real Estate Is

Kino Bay Real Estate is a listing and lead-generation marketplace for properties in Bahía de Kino, Sonora, Mexico. Kino Bay Real Estate is not a real estate broker, real estate agent, escrow provider, legal advisor, financial advisor, or party to any property transaction.

Kino Bay Real Estate helps connect buyers, renters, property owners, agents, and developers. All negotiations, agreements, inspections, payments, leases, purchases, and other transactions occur directly between the parties, off-platform.

No On-Platform Transactions

Kino Bay Real Estate does not process, hold, transfer, or guarantee funds between buyers, renters, sellers, owners, agents, or developers. No lease agreements, purchase contracts, or property payments between users are executed through Kino Bay Real Estate.

Kino Bay Real Estate is not responsible for the outcome of any transaction, communication, agreement, or dispute between users.

Listings and Property Information

Property information is provided by owners, agents, developers, or other listing submitters. Kino Bay Real Estate does not independently verify property details, and publication of a listing does not imply that its information has been reviewed, verified, vetted, or endorsed by Kino Bay Real Estate. Users should independently verify property details, ownership, legal status, availability, pricing, taxes, permits, measurements, condition, and any other information before making decisions or entering into any agreement.

Listing prices are managed in USD. MXN prices, when shown, are estimated from USD using the platform exchange rate. Final pricing and currency should be confirmed directly with the owner.

Subscriptions and Billing

Listing owners may pay a recurring subscription fee to publish properties on Kino Bay Real Estate. Subscription billing is processed securely by Stripe. We do not store credit card or payment information.

Subscriptions may be managed or cancelled through the owner dashboard or by contacting us. Published listing access may depend on an active subscription or other applicable listing arrangement.

User Conduct

Users agree to provide accurate information, not to misrepresent properties or identities, and not to use Kino Bay Real Estate for unlawful, fraudulent, abusive, or misleading purposes. Users who submit a property listing represent and warrant that they are the property's legal owner or are otherwise authorized by the owner to list, advertise, and respond to inquiries about that property on the platform. We reserve the right to remove listings, restrict access, or disable accounts that violate these terms, appear inaccurate, are reported as misleading, or may harm the platform or its users.

Changes to the Platform

We may update, modify, suspend, or remove features, listings, pricing, or services at any time. We may also update these Terms of Use from time to time. The "Last updated" date will reflect the latest version.

Subscriptions, Cancellations, and Refunds

Paid listing plans are prepaid subscription services that provide publication, hosting, visibility on the platform, inquiry tools, and related support. Publication happens automatically once payment is confirmed. Payment does not imply that Kino Bay Real Estate has reviewed, verified, vetted, or endorsed the listing, the property, or the seller. All subscription sales are final and non-refundable once purchased, except where required by applicable law.

You may cancel future renewals through the subscription controls available in your owner dashboard. If you cannot access your dashboard or need help canceling, contact us at hola@kinobayrealestate.com. Canceling a subscription stops future renewals but does not refund the current paid period.

If a listing is removed or suspended because it violates these Terms, no refund or credit will be provided.

Subscription plans are prepaid for the billing period selected at checkout and are final sale. They are not refundable or prorated except where required by applicable law.

Site Content and Intellectual Property

The Kino Bay Real Estate website, including its design, layout, source code, brand name, logo, and the compiled and organized presentation of listing data, is the property of Kino Bay Real Estate and is protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of the platform itself to any user.

Property photos, descriptions, and other content submitted by owners, agents, or developers remain the property of the party who submitted them, subject to the license described below.

License to Submitted Content

By submitting photos, descriptions, or other content for a listing, you grant Kino Bay Real Estate a non-exclusive, royalty-free license to host, display, resize, and reasonably reproduce that content on the platform for as long as the listing remains active, and in connection with reasonable promotion of the platform. You confirm that you have the right to submit this content and to grant this license.

Prohibited Use

You may not scrape, crawl, harvest, or otherwise systematically extract listings, pricing, images, or other data from Kino Bay Real Estate using automated means, except for standard search engine indexing that complies with our robots.txt. You may not copy, reproduce, republish, or create a derivative platform from Kino Bay Real Estate's design, brand, or aggregated listing data without our prior written permission. We may restrict, rate-limit, or block access from any source we reasonably believe is engaged in prohibited automated access.

Limitation of Liability

To the maximum extent permitted by applicable law, Kino Bay Real Estate and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business opportunity, arising from your use of the platform or any transaction, communication, or agreement between users. Our total liability for any claim arising from these Terms or your use of the platform will not exceed the amount, if any, you paid us in the twelve (12) months before the claim arose.
